1. Welcome to KoloWorld
KoloWorld (“we”, “us”, “our”) provides a digital platform that helps groups of people organise private rotating savings circles — sometimes known as a Kolo, Esusu, Ajo, Susu, Tanda, Chama, Hui, or Cundina. By creating an account, joining a group, or otherwise using the service, you (“you”, “member”) agree to these Terms of Service (the “Terms”). If you do not agree, please do not use KoloWorld.
2. What KoloWorld is — and is not
KoloWorld is a coordination tool. We provide software that helps members track contributions, payout order, cycles, and group communication. We are not a bank, money transmitter, payment processor, escrow agent, or financial institution. We do not hold, custody, transfer, lend, or insure any funds on behalf of members. All money moves directly between members through whatever payment method they choose to use outside of KoloWorld.
Each savings group is a private agreement between its members. KoloWorld is not a party to that agreement and is not responsible for member behaviour, missed contributions, disputes, fraud, or any financial loss arising from participation in a group.
3. Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction).
- You must have the legal capacity to enter into a binding contract.
- You must not be barred from using the service under any applicable law.
- You must provide accurate, current, and complete information when registering.
4. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that happens under your account. Notify us immediately if you suspect any unauthorised access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are involved in fraudulent or harmful activity.
5. Groups, contributions, and payouts
When you create or join a group you agree to the group’s rules, including the contribution amount, frequency, payout order, and any additional rules set by the group creator. Contributions are tracked in KoloWorld but actually move between members directly. Marking a contribution as “paid” reflects what members report — it is not a guarantee by KoloWorld that any payment was made.
Group creators are responsible for confirming receipt of payments, managing the payout schedule, and acting fairly toward all members. Members are responsible for paying on time and communicating any issues to the group.
6. Acceptable use
You agree not to:
- Use KoloWorld for money laundering, fraud, gambling, or any unlawful purpose.
- Misrepresent your identity or impersonate another person.
- Harass, threaten, or harm other members.
- Reverse-engineer, scrape, or attempt to disrupt the service.
- Use the service to collect funds from people who have not freely consented to join the group.
7. Fees
KoloWorld may introduce fees for some features. Where a fee applies, it will be disclosed before you incur it. We do not charge members for ordinary participation in a group at this time, but we reserve the right to change pricing with reasonable notice.
8. Disputes between members
Disputes about missed contributions, late payments, or payout order are between the members of the affected group. KoloWorld may provide tooling to help groups raise and discuss disputes, but we do not arbitrate, mediate, or guarantee any outcome. We may, at our sole discretion, suspend members or groups that repeatedly violate these Terms.
9. Intellectual property
KoloWorld and all related software, branding, and content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. You retain ownership of any content you submit, but you grant us the rights needed to operate the service (for example, displaying your announcements to other members of your group).
10. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any data will be preserved indefinitely.
11. Limitation of liability
To the maximum extent permitted by law, KoloWorld will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or funds arising out of or relating to your use of the service or your participation in any group. Our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the fees you paid to us in the twelve months before the claim arose or (b) USD 50.
12. Indemnity
You agree to indemnify and hold KoloWorld harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another person or group.
13. Termination
You may stop using KoloWorld and delete your account at any time from your profile settings. We may suspend or terminate your access if you violate these Terms or if we discontinue any part of the service. Sections that by their nature should survive termination (including disclaimers, limitations of liability, and dispute resolution) will survive.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above and, where appropriate, notify you in the app. Continued use of the service after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by generally accepted principles of international commercial law, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally should first be raised with us in writing. Where local consumer protection law gives you stronger rights, those rights are not affected by this section.
